The following terms and conditions shall apply to purchases of goods at our online shop.
2. Contractual partner, conclusion of contract
The contract of sale comes into being with NewMoove Deutschland GmbH. The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue. You can add products to the shopping basket, free and non-binding. You are able to correct your entries at any time prior to sending a binding order by using the correction tools provided during the ordering process. By clicking the order button you submit a binding order for the goods contained in your shopping basket. Confirmation of receipt of the order is provided by email after sending the order and does at that stage not constitute acceptance of a contract. We can accept your order by means of a separate order confirmation sent by email or by delivery of the goods. NewMoove Deutschland GmbH will process and deliver orders promptly. Orders can only be submitted by individuals aged 18 and above.
Contract language is German.
We will save the contract and send an e-mail including your order details and our terms and conditions to you. Furthermore, you can inspect and download our terms and conditions form this website at any time. Previous orders may be viewed in your customer account as soon as you have signed in.
3.Terms of delivery and shipping costs
Shipping costs amount to 4,90 Euro per shipment to Germany. From a value of 29 Euro we deliver free of charge.
Shipping costs amount to 6,90 Euro per shipment to Austria. From a value of 49 Euro we deliver free of charge.
Shipping costs amount to 9,90 Euro per shipment to Switzerland. From a value of 99 Euro we deliver free of charge.
Collection by the customer is excluded.
The purchase price is due as soon as the contract comes into force unless otherwise agreed. The following payment options are available in our online shop:
SEPA direct debit
If you give us a SEPA Direct Debit Mandate, payment is made by direct debit from your bank account. The debit is made in advance prior to the shipment of your order. You will receive a separate preannouncement before your account is debited.
When paying by credit card, we charge your credit card account with the conclusion of the contract. When the credit card payment mode is chosen, we will not charge any additional costs for this payment option.
You will pay the amount due via the online payment provider Paypal. You have to be registered there in order to identity by entering the access data and thus confirming your payment (except guest accounts). You will receive further information during the ordering process. If you choose Paypal or Paypal express, we will not charge any additional costs for this payment option.
We also offer immediate transfer, which means that we will receive the bank transfer immediately. All you need is your account number /IBAN, bank sort code /BIC, PIN and TAN. Using the secure Sofort AG payment form, not accessible for any merchant or third party, the customer automatically triggers a credit transfer to the merchant. The purchase amount is immediately transferred directly into the merchant's bank account. When choosing immediate transfer there will open up a pre-filled form at the end of the ordering process. This form already contains our bank account, the transfer amount and the reason for payment. Now you must select the country in which your bank account is held and enter the bank sort code /BIC. Now please enter the same login data that you use for online banking (account number /IBAN and PIN). Now you must confirm your order by entering the TAN. You will receive confirmation of the transaction immediately afterwards. Essentially, you can use immediate transer as a payment method if you have an activated online banking account with a PIN/TAN. Please note that a small number of banks do not yet offer instant bank transfer as an option. 5. Bonus Points
Redeeming bonus points
You can acquire bonus points on the NewMoove fitness website (www.newmoove.com) or in the NewMoove online shop (www.webshop.newmoove.com), e.g. by successfully completing fitness classes, giving class evaluations or shopping items in the online shop. Each bonus point is worth 0,01 €. The bonus points acquired can be redeemed in the NewMoove online shop at any time within 180 days. Per order you can redeem your bonus points for up to 15% of the value of the goods. The remaining amount is to be paid in cash. Your bonus points will expire after 180 days.
A voucher is redeemable in the NewMoove online shop at any time, but only once. You will find a field “Redeem voucher” in your shopping basket, where you can enter your voucher code. Having clicked on “Redeem” the amount due shall be reduced by the voucher amount, if the minimum order value is achieved. The minimum order value is as follows:
5 Euro voucher = 25 Euro
10 Euro voucher = 50 Euro
20 Euro voucher = 75 Euro
30 Euro voucher (or higher) = 100 Euro
Vouchers are not transferable and can be redeemed only once. Vouchers are non-refundable. It is not possible to redeem more than one voucher at a time. In case of cancellation or return of goods the redeemed voucher expires irreversibly and there will be no replacement. If you have redeemed a voucher on your order and you are returning your order partially, we reserve the right to charge the full price for the kept goods, when the value of the remaining order is less than the value of the voucher. It is not possible to combine vouchers and bonus points (see No. 5). The validity indicated on the voucher is binding.
7.Reservation of proprietary rights
The goods remain the property of NewMoove Deutschland GmbH until full payment.
8. Damage during shipment
If goods are delivered with apparent transport damages, please reclaim such faults immediately to the deliverer, and contact us as fast as possible. Failure to file a complaint or to contact us does not have any influence on your legal warranty claim. However, you help us to be able to assert our own claims towards the forwarder or rather transport insurance.
9. Warranty and guarantee
The statutory warranty rights shall be applied. Claims for defects of goods offered in the NewMoove online shop are limited to 24 months from the transfer of risk. According to the legal regulations you can choose to have the defect rectified, or the goods replaced. NewMoove Deutschland GmbH can refuse the type of subsequent performance chosen by you, if it requires excessive costs. If the subsequent performance is unsuccessful, the customer shall be entitled to demand rescission or a price reduction and to demand damages or reimbursement of fruitless expenses at his option. You will find further information on relevant producer guarantees and its conditions on the product page and on special info pages (“Claims for defects”) in our online shop.
10. Limitation of liability
The right of the customer to claim compensation is excluded, except for compensation to the customer for injury to life, body, health or from violating essential obligations of the contract, as well as liability for other damages, which are based on premeditated or culpable negligence of NewMoove Deutschland GmbH and its representatives or agents. Essential contractual commitments are those, which enable the fulfilment of the orderly performance of the contract. NewMoove Deutschland GmbH shall only be liable for typical contractual and foreseeable damage if such damage is based on minor negligence, unless the claims for damages are attributable to the loss of life, physical injury or detrimental effects on health. The above mentioned liability limitations also apply in favour of legal representatives and performing agents of NewMoove Deutschland GmbH, if claims are aimed directly at them. Liability according to the stipulations of the Product Liability Law remains unaffected.
11. Applicable Law, place of jurisdiction
All legal transactions or other legal relations with us are subject to the law of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) and any other international conventions, even after being incorporated in German law, shall not be applicable. For contracts of a propose that can not be counted under profession or a business of the legitimate claimant (consumer), this choice of law is only valid if the offered protection is not withdrawn through cogent law of the country where the consumer has his usual residence.
12. Modification of the General Terms and Conditions
We may change or modify these terms and conditions unilaterally at any time, as long as they have been introduced in the business with the customer. Reasonable changes are those made to correct a disturbance of equilibrium, unintended omissions, or changes made for technical reasons, in particular improvements to services. We will inform the customer about any modifications including the contents of the modified regulations. If the Customer does not terminate the contract within 6 weeks after receipt of the notification of change in writing, the changes will become an integral part of the contract
